In January 2014, the South Bend Police Department illegally seized our clients property, valued at $250,000, using fabricated “parking violations” as a pretext. They disregarded Indiana Code 9-22-1-11, which mandates that any vehicle marked for impoundment due to parking issues must be clearly red-tagged, notifying the owner of impending action. No such tag was placed on their property, violating Indiana Code’s due process protections regarding vehicle seizure. Further, this enforcement was selectively applied to them while other similarly parked vehicles were left untouched, infringing upon their rights to equal protection under the 14th Amendment of the U.S. Constitution.
When they took steps to seek the return of their property, they only encountered resistance and denial at every turn. In their pursuit of justice, they recorded officials from the South Bend Mayor’s Office, South Bend Police, and ST. Joe County Prosecutor’s office blatantly denying their right to file a formal report or retrieve their property. According to Indiana Code 35-42-3-3, it is unlawful for public servants to interfere with an individual’s rights by knowingly or intentionally obstructing a lawful course of action. By refusing our clients report and withholding property, they knowingly obstructed the law to protect their own interests.
Six months later, on June 30, our client was hit with retaliatory charges, including four falsified felonies, under the guise of a “911” emergency call for help that the Police themselves admit they ignored. This contravenes Indiana Code 36-8-16.7-23, which mandates law enforcement’s duty to respond to emergency calls. The prosecution’s office also violated Indiana Code 35-44.1-2-2, which prohibits public officials from falsifying records, as their accusations misrepresented facts documented in our clients recordings.
Through Ball Breaker Legal strategic approach, these injustices were brought to light. Our legal team compiled video and audio evidence proving perjury on behalf of the St. Joseph County Prosecutor’s Office. We also underscored the police’s actions as intimidation tactics—clear harassment as prohibited by Indiana Code 35-45-2-1—which forbids conduct intending to provoke fear or retaliation for exercising lawful rights.
Ball Breaker Legal exposed the systematic abuses, ensuring that our clients rights were protected and the case dismissed. Our firm fought tirelessly, holding officials accountable and bringing justice to a deeply corrupted process. In the end, we freed our client from false chains.
